Abstract

LOPEZ BRAVO, Alfredo. Integration law as a guarantor of human rights in the face of the emergence of new technologies. Rev. secr. Trib. perm. revis. [online]. 2026, vol.14, n.23, e573.  Epub Mar 23, 2026. ISSN 2304-7887.  https://doi.org/10.16890/rstpr.a14.n23.e573.

Abstract: The European Union has consolidated a position of systemic leadership in the regulation of emerging technologies, establishing normative standards with global reach. This article examines Integration Law as a central legal framework for the protection of human rights in the context of accelerated digitalization. It focuses on three core regulatory pillars of the European model: the General Data Protection Regulation (GDPR), the Artificial Intelligence Act (AI Act), and the Markets in Crypto-Assets Regulation (MICA). Through the analysis of the case law of the Court of Justice of the European Union and the evolution of international data transfer regimes, the article argues that supranational harmonization provides an effective response to the power asymmetries inherent in the digital ecosystem, balancing technological innovation, legal certainty, and the primacy of human dignity. The study concludes that the European integration model represents a leading example of digital constitutionalism with global influence.
