Resumen

FRANCO M., Shirley D. et al. Access to justice for indigenous women in the Nivaclé, Chaco Paraguayan community. Acad. (Asunción) [online]. 2019, vol.6, n.1, pp.1-8. ISSN 2414-8938.  https://doi.org/10.30545/academo.2019.ene-jun.1.

Access to justice for indigenous women is one of the important challenges in a social Rule of Law because it implies compliance with the principles of equality and non-discrimination, but in spite of the constitutionalization of the rights of indigenous peoples and the protection of the rights of these vulnerable groups, little progress has been made in this regard. The present work is the presentation of the results of the university extension activity carried out by a multidisciplinary team of the degree courses of the Universidad Americana of Asuncion. The objective is the analysis of data on the current situation of access to justice for indigenous women of the Nivaclé or Nivacché from Chaco Paraguayan communities, belonging to the Mataco Paraguayan linguistic family, conducted through interviews with 19 indigenous women, between 20 and 54 years old, 11 of the Fischat Community and 8 of the Cacique Sapo Community. The results show the difficulties for access to justice for women related to discrimination because of their status as women an indigenous, domestic violence of which they are victims, the lack of legal instances to carry out the complaints and the activation of community justice rather than the ordinary.

Palabras clave : Access to justice; indigenous women; the principles of equality and non-discrimination.
