The MERCOSUR process is an intergovernmental process, and this situation is too damaging to the progress of MERCOSUR due to the limiting legal nature of its component bodies. The possibility of change of the MERCOSUR bodies is an emerging reality, which can not be ignored by the authorities of the States Parties of the Mercosurian system. The supranationality must be considered as a necessity in the XXI century, despite having had its genesis in the second half of the twentieth century. Before that historical time was unknown, because there is no functional process or structural existence of that order. Inter-State relations were governed by the traditional procedures of classical diplomacy, which were implemented through bilateral or multilateral treaties for the definition of interests between States Parties. Often these transactions were carried out based on their territorial and economic rights of domestic contents, justified and protected mainly in the closed, unilateral and selfish exercise of powers derived from principles of self-determination and national sovereignties radicalized and therefore sectorized. These processes of integration as an operational product, generate a dynamic normative activity, translated into resolutions, decisions, circulars and consultative opinions, which according to the nature of the integration process can be part of the normative body of the State Party and Mercosurian soft law.
