Abstract: This paper examines the work and progress among the States of the Southern Common Market (MERCOSUR) in the field of maritime-river transport and, subsequently, highlights the importance of having an instrument applicable to this type of commercial service. The proposal also contains some reflections on comparable experiences in dispute settlement that may be suitable for a future arbitration design compatible with the Protocol of Olivos for Dispute Settlement in MERCOSUR.
