Abstract: The case of the ‘ SPITZENKANDIDATEN’ is analized in the election of the President of the EU Comission in 2019. It is pointed out the breach of what is implicit under that denomination : that the President of the Comission should arise from the candidate proposed by the group politician in the European Parliament with more votes in the last parliamentary election. Different alternatives are proposed for its implementation.
