Abstract: This article emphasizes that the authority to enter into executive agreements derives from the national legal order, and not from international law or the text of the treaty. It seeks to demonstrate that the executive nature of a treaty does not depend on the moment of its entry into force. It indicates that the authority to conclude executive agreements is independent of the bilateral or multilateral nature of the treaty.
