Abstract: In this work we discuss the complexities of transnational relations that are inserted in pharmaceutical contracts between States and Transnational Pharmaceutical Companies, particularly in the field of clauses that establish transnational arbitration, and the constitution of non-sovereign funds as guarantee of performance. We intend to show that these clauses are legitimate in the context of Transnational Law, where States act as non-sovereign actors, and that they are guided by favor creditoris logic. The critical method and the bibliographic research procedure were used.
