Abstract: This article aims to analyze trade disputes related to environmental protection submitted to the dispute settlement system of MERCOSUR and to that one of the World Trade Organization. The ressearch brings an overview on the possible difficulties for the effective promotion of the protection of the environment in systems designed for the solution of trade disputes. Through the analysis of decisions on cases confronted with those standards, the conclusions tend to confirm the hypotesys that trade interests tend to prevail pushing environmental protection a secondary role.
