Abstract

KLEIN VIEIRA, Luciane  and  NARDON MARTINS, Lais. Indigenous America: a comparative study on the rights of indigenous peoples in MERCOSUR and in Andean Community. Rev. secr. Trib. perm. revis. [online]. 2022, vol.10, n.19, pp.45-72.  Epub Oct 11, 2022. ISSN 2304-7887.  https://doi.org/10.16890/rstpr.a10.n19.e488.

Abstract: The present work is guided by the following problem: to what extent do the integration processes of the MERCOSUR and the Andean Community (CAN) guarantee and promote the rights of indigenous peoples? Therefore, the research has as its general objective the study of the rights of indigenous peoples in MERCOSUR and CAN. This objective focuses on the study of regulations and information provided by the integration processes analyzed, discussing, in the first chapter, on the rights of indigenous peoples in MERCOSUR, and, in the second, on the rights of indigenous peoples in the CAN, analyzing the historicity of economic blocs and the rights of their citizens. As for the methodology adopted, normative-described and comparative research methods were used, with bibliographic and documentary research techniques. As a result, it was found that Andean integration is more advanced, at least theoretically, in terms of indigenous legislation and policies that involve the citizen figure of native peoples, although there was no mention of the use of indigenous languages as CAN languages, which is indeed observed in MERCOSUR. Both integration processes have their own institutions for representing indigenous peoples, such as the Meeting of Authorities on Indigenous Peoples (RAPIM) in MERCOSUR and the Council of Indigenous Peoples in CAN (CCPICAN).
