Element of flexibility as well as controversial, assessments made by the EU Court of Justice regard-ing preliminary rulings referred to it constitute an expression of distinctive judicial independence. Such positions have led in some cases to a refusal to answer the doubts submitted from national administrative departments. Faced with such disturbing examples, this study proposes a scientific methodology for a better understanding, by taking into account one of the most recently produced, which precisely affects a Spanish administrative body.
