International society, from the global governance process, has intensified criticism about the insufficiency of international institutions and international law itself to give this society a voice. The democratic models of society are in crisis, which manifests itself in discussions about the representativeness of participation and the legitimacy of political actors involved in decisions that affect the future of humanity. The purpose of this article is to emphasize the need to modernize international institutions and international law. Today’s world is more cosmopolitan and orderly based on global governance structures and multilateral practices developed over the years. International law continues to be of great importance in the ordering of global society. The study is qualitative and descriptive, developed through bibliographic references that address the main topics highlighted throughout the work. It follows that the prospects for collective action in law and politics in today’s world of fragmentation and nationalism will require the modernization of institutions and international law itself. International society has difficulties due to the fragmentation of the international system in which we live to promote better effectiveness of the global governance system.
